Terms and Conditions

Definitions

“Business” means Rachel Warrilow trading as Sitting Knitting, whose postal address is 1a Church Road, Shenstone, Lichfield, Staffordshire, WS14 0NG.

“Goods” means the article(s) which the Purchaser buys or agrees to buy from the Business.

“Parties” means both the Business and the Purchaser

“Purchaser” means any person, firm, company or organisation who buys Goods from the Business.

“Working Day” means a day which is not a Saturday, Sunday, or a bank/public holiday in England.

Acceptance

All orders are accepted by the Business subject to these Terms and Conditions of Trade unless otherwise specified and agreed in writing by the Parties.

Upon receipt of an order the Business will send an automated order acknowledgement email (to the email address supplied by the Purchaser at the time of ordering).  This email is intended purely to acknowledge receipt of the order, it does not constitute legal acceptance of the order by the Business.

No order will be legally accepted by the Business, and therefore no legal contract will exist, until such time as an email is sent by the Business (to the Purchaser (to the email address supplied by the Purchaser at the time of ordering)), confirming that the Goods ordered have been dispatched. The Business reserves the right to not accept, or cancel, any orders of items unavailable or sold out, in which case, the purchase price will be refunded in full although the Business will, under no circumstances, be liable for any losses, whether consequential or otherwise, which may arise as a result of the Business not accepting or cancelling any orders.

Price

The Business is not registered for VAT, consequently, the price displayed on the website is the total price that the Purchaser will be charged for the Goods. 

The prices on the website are exclusive of postage and packing, the cost of which will be added to the order value at the checkout stage of the ordering process unless the order qualifies for free postage and packing.  The costs for postage and packing are clearly set out during the checkout process.

The minimum order value that qualifies for free postage and packing is clearly set out on the webite, but this will only apply to UK deliveries.  All export orders will incur the postage and packing charges irrespective of the order value.

The price displayed on the website at the time of ordering will be the price charged (subject only to the following clause below).  However, the Business reserves the right to change the prices displayed on the website at any time.
The Business reserves the right, if the Goods are out of stock at the time of receipt of an order, to contact the Purchaser if the Business finds that it’s cost to restock the item has increased, to advise the Purchaser that the price has had to be increased to compensate.  If this occurs, the Purchaser has the right to cancel their order, in which case a full refund will be made.

Export Goods

The following applies for all orders where delivery is requested to non-UK addresses (export orders).

All export orders will be despatched Duty Unpaid. This means we are only charging the Purchaser for the Goods and postage and packing. Therefore, the delivery agents will need to collect any and all Customs Import Duties, Customs Clearance Fees, Local and State Taxes and any Sales Taxes (including VAT) that may be due and payable on the Goods as a result of them being imported into the country of delivery.

Should the requested sums not be paid, the Goods will not be released to the Purchaser. In
addition, we will not issue any refund for the Goods or postage and packing that have been paid to us by the Purchaser.

Terms Of Payment

Payment must be made at the time of order.  No orders will be accepted without accompanying payment.

In respect of on-line sales the Business accepts payment by major credit and debit cards via its third party payment processing partner, Square.  All payments are handled solely by Square on behalf of the Business and the Business will never be in possession of a Purchasers credit or debit card details.

No other payment method will be accepted by the Business for on-line sales.

No order will be dispatched until payment has been cleared.

Delivery

The Business will use reasonable endeavours to dispatch all orders within two business days, subject to stock availability.

All deliveries to UK addresses will be made by parcel carrier standard delivery which normally takes a few days to most UK addresses.

All deliveries to overseas addresses will be made using Royal Mail Business Parcels service.

All delivery times quoted are intended as a guide only.  Whilst the Business will take all reasonable steps to try to ensure that carriers meet these times, the Business cannot accept any liability whatsoever for delays caused by matters beyond our control either from carriers, suppliers or for any consequential loss as a result.

Where any items ordered are out of stock, the Business will endeavour to contact the Purchaser via email to advise them of this fact and to advise of the expected dispatch date.  Where such items are part of a multiple item order, then the same procedure will apply, and the Business reserves the right, at its sole discretion, to either ship the order in multiple parts or dispatch the whole order once the missing items are available.

Specifications

All reasonable care has been taken to ensure that every item shown on the Business’s website is accurately described.  All information stated in respect of a product has been obtained from manufacturer/importer provided data. 

The Business makes every reasonable effort to ensure that photographs of Goods are an accurate representation of those Goods.  However, given that different light conditions affect the perception of colour, the Business cannot guarantee the product colour will be an exact match to the photograph on our site, especially as manufacturers production batches do have subtle variations in colour and hand dyed yarns by their very nature will always vary in colour between each and every skein.

Suitability

Every reasonable care is taken to ensure that products are suitable for the use intended and described accordingly.

The Business cannot, and does not, accept any liability for injury howsoever caused by the use of products sold.

Return Of Goods

Returns will only be accepted if the Business is notified in writing, via email using the “Contact Us” function on the website, stating the reasons why the Purchaser wishes to return them prior to goods being returned to the Business and provided that the Purchaser completes our standard “Returns Form” that will be sent to them and returns this with the Goods being returned .

Returns will also only be accepted where the Business receives such written notification within 14 days of the Goods being delivered to the Purchaser.  For these purposes, delivery will be assumed to have occurred 4 Working days after dispatch in the case of UK delivery, and 7 Working days after dispatch for all overseas deliveries.

Returns may be made for any reason, not just in the case of damaged or incomplete items.  However, a return will not be permitted where the product has clearly been used, or damaged in any way (including where it has been exposed to a damp or smoke environment where it is returned with an embedded smell) unless the Business accepts the item was faulty upon dispatch from us.

Goods returned must be received by the Business in reasonably good condition and with their original packaging and in the original quantity.

Upon notification of any Goods being damaged or incomplete on delivery, the Business will despatch replacement Goods as soon as the damaged/incorrect items are returned (unless the Business informs the Purchaser that the relevant goods need not be returned), unless the Purchaser notifies the Business that they do not wish to receive replacement Goods but would prefer a refund instead.

The Business will refund the cost of return postage in all cases where the goods are either incomplete or damaged.  Where a return is being made simply because the Purchaser has changed their mind, no such refund will be made.  In any event, a refund, where appropriate, will only be made in respect of Standard Class postage, and only where the Purchaser can provide suitable evidence of the cost incurred, ie a valid receipt in respect of that specific postage back to our postal address.

Where the Purchaser returns all of the Goods for any reason (and does not wish to receive replacements), then the Business will refund not only the cost of the Goods themselves, but also the postage and packing charge levied on the original order.  However, if the original order qualified for free postage and packing, then no such refund will be made.

The Business will make every effort to process refunds as quickly as possible but these may take up to 14 days after the Goods have been returned.  No liability is accepted by the Business for any costs or charges incurred by the Purchaser which may arise due to a delay in processing a refund if the refund is made within the 14 days.  The Business will normally process a refund through the original payment means but reserves the right to agree an alternative refund method with the Purchaser. 

The Business recommends that proof of dispatch is obtained for any Goods returned in case of loss in transit. 

Claims

Notwithstanding any other provision contained in these Terms and Conditions, the Business shall have no liability whatsoever, whether in contract, tort (including negligence) or otherwise, for any incidental, special, indirect, or consequential loss or damage including, but not limited to, loss of income, loss of profits or loss of opportunity, arising out of or in connection with the performance of its obligations under these Terms and Conditions, including such damages as may be reasonably foreseeable at the date hereof. 

General

Any information or data on the website is meant as a guide only. 

If any provision of these Terms and Conditions, is held by any competent authority to be invalid, or unenforecable in whole or in part, then the validity of the other provisions of the Terms and Conditions, and the remainder of the provision in question, shall not be affected.

Governing Law And Jurisdiction

These Terms and Conditions will be governed by the laws of England and Wales.  The Purchaser hereby agrees that any challenge to these Terms and Conditions will be under the exclusive jurisdiction of the English Courts.
